Recent changes to the Western Australian Work Health & Safety Laws have a significant impact on business owners who must understand their obligations to provide a safe workplace not only for employees but also for visitors and contractors and any other person that comes on-site.
Are you a PCBU? A new definition has been created PCBU or a “person conducting a business or undertaking”
A PCBU can include;
- a sole trader (for example a self-employed person)
- each partner within a partnership
- a company
- an unincorporated association
- a government department or public authority (including a municipal council)
What has changed so significantly?
Previously under the OSH Act duty of care was largely based on the employer-employee relationships.
NOW…under the WHS Act, all PCBU’s have a primary duty of care to ensure the health and safety of their workers and others who may be affected by the carrying out of work. This means if you are the PCBU you would need to take action to eliminate risks to health and safety. If this is not reasonably practicable you need to make sure the risks are minimised as far as is reasonably practicable. This includes paying attention to the strategic, structural, policy, and key resourcing decisions involved in running your business.
